U.S. Immigration and Customs Enforcement has responded to a Wednesday Cottonwood County Sheriff's Office press release accusing ICE of making an inaccurate social media post about an incident in the county.
Stated the response: "When ICE requests a detainer on a violent criminal illegal alien being held in a jail/prison, INA 287(d)(3) states that the criminal illegal alien must be held for up to 48 hours.
"Cottonwood County, two hours away from the nearest ICE facility, gave us a 30 minute heads-up that they were releasing this alleged child predator back into their community.
"That is neither practical nor is it honoring our detainer. We are happy to place an ICE officer(s) in your jail if that would make honoring our detainers easier for your team."
