WORTHINGTON – The Minnesota Court of Appeals on Monday affirmed the conviction of Generson Mauricio Ruiz-Lainez, who was declared guilty in 2019 of five counts of third-degree criminal sexual conduct.
Court documents show that Ruiz-Lainez was accused of having intercourse with two different 13-year-old girls, who were later interviewed by a physicians assistant at Child’s Voice, a facility that comports forensic interviews regarding domestic and sexual abuse cases in children.
Ruiz-Lainez contends the PA who testified during the trial vouched for the victims’ credibility in her own trial testimony by stating the disclosures by the girls were consistent with sexual abuse.
According to the appellate court opinion, the PA did not offer a conclusion about whether or not the children were telling the truth or whether the abuse had occurred, but stated what they disclosed was consistent with sexual abuse.
Ruiz-Lainez was sentenced to 60 months in prison.
